Arbitration is a binding process agreed to in writing by the parties in order to resolve their disputes. As with the mediation process the parties define the scope of the dispute, the manner in which the dispute is is submitted and the procedural or substantive law that the arbitrator will apply.
Among the advantages of arbitration are that the parties can select an arbitrator experienced in the field of the dispute. Further, the proceedings are private and the time and location of the arbitrations are mutually agreed. Finally, the arbitration award can be submitted to the appropriate court for confirmation.
